FALL BALL SWEEPSTAKES
OFFICIAL RULES
Contest Name: AUTOZONE "FALL BALL" SWEEPSTAKES (the "Contest")
AutoZone, Inc., its subsidiaries and affiliated companies (together, the "Company"), will conduct the Contest substantially as described in these rules, and by participating, each participant agree as follows:
- NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Contest begins at 12:01am Pacific Time on October 4th, 2004 and concludes at 11:59:59pm Pacific Time on October 10, 2004. To enter: visit www.autozone.com and follow all instructions to complete the online entry form including leaving your name, address, city, state, zip code, birth date, day and evening phone numbers and e-mail address. Online entries limit to one entry per person or e-mail address per day. Subsequent entries from a person or e-mail address on any single day will not be eligible for prizes. Contest winner will be drawn from online entries. By entering, entrants acknowledge compliance with the official rules including eligibility requirements. Responsibility for receipt of entry rests solely with the entrant. The Company, Clear Channel Worldwide, and Premiere Radio Networks, Inc. (together, the "Participating Sponsors") will not be responsible for technical or human errors in transmission of, or receipt of, telephone calls and/or miscommunication, as well as for technical or human errors in omission, interruption, deletion, defect, delay in operation or transmission, theft, destruction, unauthorized access to, or alterations of, entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by the Company on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. The Company is also not responsible for injury or damage to entrant's or any other person's computer related to or resulting from, playing or downloading any materials in the contest. The Company reserves the right to cancel or modify the contest if fraud, technical failures, or any other causes beyond the control of the Company compromise the integrity of the contest as determined by the Company in their sole discretion. No mechanical reproductions will be accepted with the exception of entries via the autozone.com home page. Entries void if defective, altered, forged, illegible, or received outside authorized channels. All entries and information become property of the Company and will not be returned.
- PRIZE DRAWING: A random drawing will be held on or about October 11, 2004 from among all eligible entries received by 11:59:59pm Pacific Time on October 10, 2004. Odds of winning depend on the number of eligible entries received. Winners agree to be bound by these rules and the decisions of an independent judging organization, whose decisions are final and binding. Winners will be notified by telephone and/or mail on or about October 11, 2004. An Affidavit of Eligibility and Liability/Publicity Release must be signed, notarized, and returned by prize winner or winner's parent/legal guardian if winner is under 18 years of age or a minor in his/her state, within fourteen (14) days of notification attempt. Prize will not be awarded until the Affidavit is completed. Failure to return the executed Affidavit within that time may result in forfeiture of prize and random selection of alternate winner from remaining eligible entries.
- PUBLICITY; USE OF PERSONAL INFORMATION: By participating, where allowed by law, all participants and winner(s) grant the Company and Participating Sponsors exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use. By participating in the Contest, where allowed by law, participants agree that the Company and Participating Sponsors may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes.
- PRIZES: One (1) Grand Prize winner will win a trip for two (2) to a TBD City. The trip includes round trip coach airfare for two (2) from the major airport nearest the winner's home to the major airport nearest the TBD City, two (2) night hotel accommodations (double occupancy), cash to purchase two (2) tickets to one (1) game of The Fall Baseball games, dinner for two (2) on one (1) night and car rental. (Approximate Retail Value: $4,000.00). Travel for the Grand Prize Winner and guest will take place by October 31st, 2004. Grand Prize Winner and guest must travel out of the same airport. Certain travel restrictions and blackout dates may apply. Participating Sponsors, in their sole discretion, reserve the right to provide ground transportation in lieu of air transportation if any of the traveling winners reside less than 100 miles from the prize destination. Additional meals, incidentals, gratuities, phone calls, and all other expenses not specifically mentioned herein are the sole responsibility of the Grand Prize Winner. The Company reserves the right to substitute any portion of this prize, including destinations and travel dates, for an alternate prize or cash substitution. No transfer or change of the prize is permitted except at the sole discretion of the Company. Unclaimed prizes will not be awarded. Other restrictions may apply. All federal, state, and local taxes on the prize are the sole responsibility of each prize winner.
- TAXES: Any valuation of the prize(s) stated above is based on available information provided to the Company and Participating Sponsors, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Winner is solely responsible for reporting and paying any and all applicable taxes related to the prize and paying any expenses associated with any prize which is not specifically provided for in the official rules. Winner must provide the Company and Participating Sponsors with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Any person winning over $600.00 in prizes from the Company and Participating Sponsors will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
- CONDUCT AND DECISIONS: By participating in the Contest, participants agree to be bound by the decisions of Company personnel. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Company's decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate this Contest, or make such other decisions regarding the outcome as the Company deems appropriate. All decisions will be made by the Company and are final. The Company may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, COMPANY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
- CONDITIONS. Entrants release AutoZone, Inc., Clear Channel Worldwide, Premiere Radio Networks, Inc., their respective directors, employees, divisions, affiliates, officers, subsidiaries, agents, advertising agencies and all others associated with the development and execution of the program, from and against any and all liability with respect to or in any way arising from this contest and the awarding and use of the prize, including liability for personal injury.
- ELIGIBILITY. Participants and winner(s) must be legal residents of the continental United States and at least 18-years old as determined by the Company. A parent or guardian of any participant who is a minor must sign a release on behalf of the minor to be eligible to receive a prize, but the Company reserves the right to refuse to award a prize to or on behalf of any minor. Only one (1) prize per household for the Contest. Employees of the Company, the Contest's Participating Sponsors and their divisions, affiliates, officers, affiliated companies, subsidiaries, agents and advertising agencies, and members of the immediate family of any such persons are not eligible to participate and win. The term "immediate family" includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as "in-laws," or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related. Subject to all laws and regulations and void where prohibited or restricted by law. Sweepstakes void in Rhode Island.
- MISCELLANEOUS: Each winner must submit proof of eligibility and sign the Company's release form to claim the prize. The Company may substitute prizes, amend the rules or discontinue the Contest at any time. The Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest. For a copy of the rules, or where required by law, a list of winners, mail a written request with a stamped, self-addressed return envelope to AutoZone's "Baseball's Big Game" Sweepstakes Winners List, P.O. Box 80,000, Los Angeles, CA 90080-1000. Winners list will be available after October 31, 2004 and through November 30, 2004. VT residents only may omit return postage. All entries become the property of the Company and will not be returned.
