  1. 2004 BOB & TOM/RODNEY CARRINGTON CAPITOL RECORDS NASHVILLE SWEEPSTAKES

  2. NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Participants and winner(s) must be legal residents of the continental United States and at least 18-years old as of March 11, 2004. A parent or legal guardian of any participant who is under age 19 in AL or NE or under age 21 in CO, MS, PA or WV must sign a release on behalf of the participant in order for such participant to be eligible to receive a prize, but the Sponsor reserves the right to refuse to award a prize to or on behalf of any minor. Only one (1) prize per household for the Sweepstakes. Employees of the Sponsor, the Sweepstakes' Participating Sponsors and their divisions, affiliates, officers, affiliated companies, subsidiaries, agents and advertising agencies, and members of the immediate family of any such persons are not eligible to participate and win. The term "immediate family" includes spouses, siblings, parents, children, IRS dependents, grandparents, and grandchildren, whether as "in-laws," or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related. Sweepstakes subject to all laws and regulations and void where prohibited or restricted by law. Sweepstakes void in Rhode Island.
  3. Sweepstakes begins at 12midnight Pacific Time on February 25, 2004 and concludes at 11:59:59pm Pacific Time on March 11, 2004. To enter, visit http://www.bobandtom.com, click on the sweepstakes banner, access the online sweepstakes entry form, and follow all instructions to complete the online entry form, including leaving your name, address, city, state, zip code, e-mail address, age, and day and evening phone number (including area code). Or, handwrite your name, address, day and evening number, email address (optional), and birth date on a postcard and mail it to: Rodney / Bob & Tom Contest, 6161 Fall Creek Road, Indianapolis, IN 46220. All mail-in entries must be mailed separately and received by March 11, 2004 Entries limited to one entry per person or e-mail address. Subsequent or duplicate entries from a person or e-mail address will not be eligible for prizes. By entering, entrants acknowledge compliance with the official rules including eligibility requirements. Responsibility for receipt of entry rests solely with the entrant. None of Capitol Records Nashville, a division of Capitol Records, Inc. ("Capitol Records Nashville"), Touchstone Television Productions, LLC ("Toucshtone"), its parent, affiliated, related and subsidiary companies and entities, and the directors, shareholders, employees, and agents of each of them, The Bob & Tom Show, each affiliate radio station, Premiere Radio Networks, Inc., and their related companies ("Participating Sponsors") will not be responsible for technical or human errors in the transmission of, or receipt of, telephone calls and/or miscommunication, as well as for technical or human errors in the omission, interruption, deletion, defect, delay in operation or transmission, theft, destruction, unauthorized access to, or alterations of, entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. Sponsor is also not responsible for injury or damage to entrants' or any other person's computer (or components thereof) related to or resulting from their entry and participation in the Sweepstakes or their playing or downloading any materials in the Sweepstakes. Sponsor reserves the right to cancel or modify the sweepstakes if fraud, technical failures, human error, or any other causes beyond the control of Sponsor compromise the integrity of the sweepstakes as determined by Sponsor in their sole discretion. No mechanical reproductions will be accepted with the exception of entries via the bobandtom.com home page. Entries void if incomplete, defective, altered, forged, illegible, or received outside authorized channels. All entries and information become property of Capitol Records Nashville (the "Sponsor") and will not be returned. Sweepstakes is subject to these Official Rules and all applicable federal, state and local laws.
  4. PRIZE DRAWING: Winner will be selected in a random drawing to be held on or about March 12, 2004 from among all correct, eligible entries received by 11:59:59pm Pacific Time on March 11, 2004. Odds of winning depend on the number of eligible entries received. Winner must be able to travel March 31, 2004 - April 3, 2004. Winner agrees to be bound by these rules and the decisions of Premiere Radio Networks, Inc., an independent judging organization, whose decisions are final and binding. Winner will be notified by telephone and/or mail on or about March 12, 2004. An Affidavit of Eligibility and Liability/Publicity Release, and Touchstone's standard Trip Release and the applicable employment eligibility documentation, must be signed, notarized, and returned by prizewinner within seven (7) days of notification attempt. If winner or any guest is under age 19 in AL or NE or under age 21 in CO, MS, PA or WV, his or her parent or legal guardian must also sign the applicable releases and required documentation. Prize will not be awarded until the Affidavit is completed. If a potential winner cannot be reached after 5 days from first notification attempt, or fails to return each of the executed Affidavit, Touchstone's Trip Release and applicable employment eligibility documentation within the required time frame, then forfeiture of prize and random selection of alternate winner from remaining correct, eligible entries may result. Except where prohibited by law, by accepting any prize, winner and guest(s) consent to the use of their likeness, biographical information, photograph, name, address (city and state only), statements or voice for advertising and publicity purposes in any and all media whether now known or hereafter devised, in perpetuity throughout the universe (including winners list) by Capitol Records Nashville, Touchstone, The Bob & Tom Show, and Premiere Radio Networks, Inc. without additional compensation or notification.
  5. PRIZE: One (1) Prize winner will win a trip for four (4) to both Los Angeles, California and Indianapolis, Indiana. The trip includes three (3) one-way coach airline tickets for four (4) on an airline selected in Sponsor's sole discretion from the major airport nearest the winner's home to the major airport nearest Los Angeles, from the major airport nearest Los Angeles to the major airport nearest Indianapolis, and from the major airport nearest Indianapolis to the major airport nearest the winner's home, two (2) nights hotel suite accommodations (quad occupancy) in Los Angeles, one (1) night hotel suite accommodations (quad occupancy) in Indianapolis, ground transportation in Los Angeles and Indianapolis, airport transfers via limousine in the winner's home town, a personal road manager to accompany and assist the winner and guests in Los Angeles and Indianapolis, four (4) tickets to attend the taping of Touchstone's pilot television show, currently scheduled to occur on April 1, 2004 plus the opportunity for the Winner to appear as an Extra in one (1) scene during the taping of the pilot television show "That's Just Rodney" if such Winner completes the appropriate documentation in connection with such appearance, VIP dinner for four (4) at Morton's Steakhouse in Burbank, California, dinner for four (4) at St. Elmo's Steak House in Indianapolis, Indiana, priority seating for four (4) and backstage access at the Rodney Carrington concert at the Murat Theater in Indianapolis on April 2, 2004, five hundred dollars ($500) spending money for food and tips, two (2) Rodney Carrington gift packs, two (2) Bob and Tom gift packs (Approximate Retail Value: $4,500.00). Winner's chance for an Extra role on the above referenced pilot television show and all details of that role to be determined by Touchstone, in Touchstone's sole discretion, subject to availability and production exigencies. In the event that any prize component is not available for any reason, the remaining elements of prize shall constitute full satisfaction of Sponsor's prize obligation to winner and no additional compensation will be awarded. As a condition to receiving the grand prize, winner must agree to sign Touchstone's applicable release and employment eligibility forms and that Sponsor reserves the right to change travel dates and to change the program on which winner will have an Extra role. Travel will take place between March 31st, 2004 and April 3rd, 2004. No change, extension or substitution of trip date is permitted, except by Sponsor at its sole discretion. Grand prize winner who cannot comply with this condition will forfeit his/her right to the prize and an alternate winner may be selected. If winner or winner's guest(s) is under age 19 in AL or NE or under age 21 in CO, MS, PA or WV), winner and/or winner's guest(s) must be accompanied by his or her parent or legal guardian. Winner and guests must travel together, out of the same airports and on the same itineraries. Certain travel restrictions and blackout dates may apply and Sponsor is not responsible for cancellation or change of performance. Meals, incidentals, gratuities, phone calls, and all other expenses not specifically mentioned herein are the sole responsibility of prize winner. Guests of Winner will not be included as Extras on the above referenced pilot television show. Sponsor does not guarantee that Winner's Extra role will be included in the broadcast version of the television show. Sponsor reserves the right to substitute for any portion of this prize, including destination and travel dates, for an alternate prize or cash substitution. No transfer, change, or cash substitution of the prize is permitted except at the sole discretion of the sponsor. Unclaimed prize will not be awarded. Other restrictions may apply. All federal, state, and local taxes on the prize are the sole responsibility of the winner. Entrants agree that the Sponsor has neither made nor is responsible for any representation or guarantee, express or implied, in fact or in law, relative to the prize.
  6. TAXES: Any valuation of the prize(s) stated above is based on available information provided to the Participating Sponsors, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Winner is solely responsible for reporting and paying any and all applicable taxes related to the prize and paying any expenses associated with any prize which is not specifically provided for in the official rules. Winner must provide the Participating Sponsors with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Any person winning over $600.00 in prizes from the Participating Sponsors will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
  7. CONDUCT AND DECISIONS: By participating in the Sweepstakes, participants agree to be bound by the decisions of Sponsor personnel, which decisions are final and binding in all respects. Persons who violate any rule, gain unfair advantage in participating in the Sweepstakes, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Sponsor will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Sweepstakes and the Sponsor's decisions concerning such disputes shall be final and binding in all respects. If the conduct or outcome of the Sweepstakes is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Sponsor, the Sponsor reserves the right to terminate this Sweepstakes, or make such other decisions regarding the outcome as the Sponsor deems appropriate. All decisions will be made by the Sponsor and are final and binding in all respects. The Sponsor may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS SWEEPSTATAKES, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTATAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
  8. CONDITIONS. By entering the Sweepstakes, all entrants release Capitol Records Nashville, Touchtone its parent, affiliated, related and subsidiary companies and entities, and the directors, shareholders, employees, and agents of each of them, The Bob & Tom Show, each affiliate radio station, Premiere Radio Networks, Inc., their respective directors, employees, divisions, affiliates, officers, affiliated companies, subsidiaries, agents, agencies, service providers, advertising agencies and all others associated with the development and execution of the program (including prize suppliers) (collectively, the "Sweepstakes Entities"), from and against any and all liability with respect to or in any way arising from the Sweepstakes or any entrant's participation in the Sweepstakes, or from the awarding, acceptance use or misuse of the prize, including liability for losses, injuries or expenses of any kind (including, without limitation, property damage, personal injury and/or death). By entering the Sweepstakes, entrants also grant to Sponsor the right to use entry information for marketing purposes to the extent permitted by law, and release the Sweepstakes Entities from any claims or liability relating to such use.
  9. JURISDICTION: Any claims or lawsuits related to the Sweepstakes brought against any Sponsor or Participating Sponsor shall be brought in the federal or state courts of the State of Tennessee. By participating in the Sweepstakes, entrants agree to the jurisdiction and venue of such courts and waive all objections to such jurisdiction and venue.
  10. MISCELLANEOUS: Winner must submit proof of eligibility and sign the Sponsor's release form to claim the prize. The Sponsor may substitute prizes, amend the rules or discontinue the Sweepstakes at any time. The Sponsor disclaims any responsibility to notify participants of any aspect related to the conduct of the Sweepstakes. For a copy of the rules, or where required by law, a list of winners, mail a written request with a stamped, self-addressed return envelope to Bob & Tom/Rodney Carrington Sweepstakes Winners List, P.O. Box 80,000, Los Angeles, CA 90080-1000. Winners list will be available after April 1, 2004 and through June 30, 2004. VT residents may omit return postage for Official Rules only. All entries become the property of the Sponsor and will not be returned.
