OFFICIAL RULES
Contest Name: GLENN BECK MAGELLAN® SWEEPSTAKES (the "Contest").
Premiere Radio Networks, Inc., ("the Company"), will conduct the Contest substantially as described in these Official Rules, and by participating, each participant agrees as follows:
- NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Sweepstakes begins at 12:01am Pacific Time on November 14, 2005 and concludes at 11:59:59pm Pacific Time on December 25, 2005. Online entries limited to one entry per person per day. Subsequent entries from a person on any single day will not be eligible for prizes. Contest winner will be drawn from online entries. By entering, entrants acknowledge compliance with the Official Rules including eligibility requirements. Responsibility for receipt of entry rests solely with the entrant. The Company, Thales Navigation, Inc, Davis Ellen Advertising, Glenn Beck, The Glenn Beck Program, each affiliate radio station and their affiliated companies, parents and subsidiaries (together, the "Participating Sponsors") will not be responsible for technical or human errors in transmission of, or receipt of, telephone calls and/or miscommunication, as well as for technical or human errors in omission, interruption, deletion, defect, delay in operation or transmission, theft, destruction, unauthorized access to, or alterations of, entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by the Company on account of technical problems, any form of active or passive filtering of any kind, insufficient space in entrant's e-mail account to receive e-mail messages or traffic congestion on the Internet or at any website or any combination thereof. The Company is also not responsible for injury or damage to entrant's or any other person's computer related to or resulting from, playing, downloading or submitting any materials in the Contest. The Company reserves the right to cancel or modify the Contest if fraud, technical failures, or any other causes beyond the control of the Company, compromise the integrity of the Contest as determined by the Company in its sole discretion. No mechanical reproductions will be accepted with the exception of entries via the www.glennbeck.com home page. The use of automated software or computer programs to register or enter the Contest is prohibited and any individual who uses or attempts to use such methods to register or to enter will be disqualified. Entries void if defective, altered, forged, illegible, or received outside authorized channels. All entries and information become property of the Company and will not be acknowledged or returned.
- ENTRY DETAILS: To enter, visit http://www.glennbeck.com, click on the sweepstakes banner, access the on line entry form, complete the online entry form, including leaving your name, address, city, state, zip code, date of birth, day and evening phone number and e-mail address..
- PRIZE SELECTION DETAILS: A random drawing will be held on or about January 6, 2006 from among all eligible entries received by 11:59:59pm Pacific Time on December 25, 2005. Odds of winning depend on the number of eligible entries received. Winner will be notified by telephone and/or mail on or about January 13, 2005. An Affidavit of Eligibility and Liability/Publicity Release must be signed, notarized, and returned by each prize winner within fourteen (14) days of notification attempt. Prize will not be awarded unless the foregoing Affidavits and Releases are completed and returned. Failure to return the executed Affidavits and Releases within that time may result in forfeiture of prize and random selection of alternate winner from remaining eligible entries.
- PUBLICITY; USE OF PERSONAL INFORMATION: By participating, where allowed by law, all participants and winner(s) grant the Company and Participating Sponsors exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other Contest and waive any claims to royalty, right, or remuneration for such use. By participating in the Contest, where allowed by law, and only to the extent permitted by the Company's Privacy Policy, participants agree that the Company and Participating Sponsors may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes.
- PRIZE(S): The prize(s) that may be awarded to the eligible winner(s) are: One (1) Grand Prize winner will win a Magellan® Roadmate 760 (Approximate Retail Value: $1,155.00) and two (2) Grand Prize winners will each win one (1) Magellan® eXplorist 500. (Approximate Retail Value each: $420.00). Total Approximate Retail Value of all prizes: $1,995.00. All other expenses not specifically mentioned herein are the sole responsibility of each winner. Participating Sponsors reserves the right to substitute any portion of this prize, for an alternate prize of equal value. No transfer or change of the prize is permitted except at the sole discretion of the Participating Sponsors. No cash equivalent for prizes will be awarded. Prizes are non-transferable. If a winner cannot be contacted or is disqualified, the Company reserves the right to determine an alternate winner or not to award that winner's prize, in its sole discretion. Unclaimed prizes will not be awarded. Other restrictions may apply. All federal, state, and local taxes on the prize are the sole responsibility of the prize winner.
- TAXES: Any valuation of the prize(s) stated above is based on available information provided to the Company and Participating Sponsors, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Winner is solely responsible for reporting and paying any and all applicable taxes related to the prize and paying any expenses associated with any prize which is not specifically provided for in the official rules. Winner must provide the Company and Participating Sponsors with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Winner will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
- CONDUCT AND DECISIONS: By participating in the Contest, participants agree to be bound by the decisions of the Company's personnel. Persons who violate any rule, engage in improper conduct, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Company's decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate this Contest, or make such other decisions regarding the outcome as the Company deems appropriate. All decisions will be made by the Company and the Participating Sponsors are final. The Company may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTEST PARTICPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE COMPANY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
- CONDITIONS. Entrants release Premiere Radio Networks, Inc., Thales Navigation, Inc, Davis Ellen Advertising, Glenn Beck, The Glenn Beck Program, each affiliate radio station, their respective directors, employees, divisions, affiliates, officers, subsidiaries, agents, advertising agencies and all others associated with the development and execution of the program, from and against any and all liability with respect to or in any way arising from this Contest and the awarding and use of the prize, including without limitation liability for death, personal injury and/or disability.
- ELIGIBILITY AND LIMITATIONS. Participants and winner(s) must be legal residents of the United States and be at least 18-years old at the time of entry as determined by the Company. A parent or guardian of any participant who is a minor must sign a release on behalf of the minor to be eligible to receive a prize, but the Company reserves the right to refuse to award a prize to or on behalf of any minor. Winners are subject to a verification process to include winner's name, address, home phone number, work/cell phone number, and social security number. Only one (1) prize per household for the Contest. Individuals who have won a prize from the Company, The Glenn Beck Program or www.glennbeck.com within 180 days (6 months) prior to the start date of this Contest are NOT eligible. Employees of the Company, the Contest's Participating Sponsors and their divisions, affiliates, officers, affiliated companies, subsidiaries, agents and advertising agencies, and members of the immediate family of any such persons are not eligible to participate and win. The term "immediate family" includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as "in-laws," or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related. Subject to all laws and regulations and void where prohibited or restricted by law. Sweepstakes void in Rhode Island.
- MISCELLANEOUS: Each winner must submit proof of eligibility and sign the Company's release form to claim the prize. The Company may substitute prizes, amend the rules or discontinue the Contest at any time. The Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest. For a copy of the rules, or where required by law, a list of winners, mail a written request with a stamped, self-addressed return envelope to Magellan Sweepstakes, P.O. Box 80,000, Los Angeles, CA 90080-1000. Winner's name will be available for six (6) months beginning January 3, 2006. VT residents only may omit return postage. All entries become the property of the Company and will not be returned or acknowledged.
- JURISDICTION: These official rules shall be governed by and construed in accordance with the laws of the State of California. Venue and jurisdiction for any claims associated in any way with these rules shall only be proper in the State of California.
